Legal Question in Bankruptcy in California
If one year after my discharge, I re-establish credit with an agency that was included in the bankruptcy, does that company have the right to make me pay back any of the discharged debt? Can they add any portion of the discharged debt on to my new credit?
1 Answer from Attorneys
Discharged debts are discharged debts, unless one has committed to a reaffirmation contract, which is an enforceable agreement to repay an otherwise dischargeable debt.
