Legal Question in Business Law in California
1. In California can an employer put an employee on the clock part time for several days without an I-9 and W-4?
2. Since the employee resigned after those few days, the Employer, required the I-9 and W-4 be completed today. Upon completion of the forms the employer told the employee she now has to wait two more weeks for her paycheck. It has already been a week since the employee resigned. CAN THE EMPLOYER DO THAT?

An employee who resigns must be paid no later than 72 hours after work is complete, pursuant to California Labor Code Section 202. Requiring the employee to wait two weeks is against the law, and would entitle the employee to penalties pursuant to California Labor Code Section 203.
