Legal Question in Business Law in California
A 17 year old wants to buy a product that his state prohibits sell to anyone under 16. This product is offered on the internet from a company that operates out of a state that prohibits the sell to anyone under 18. What laws govern this transaction? If the state laws were reversed, which laws would apply?

The law where the buyer lives would govern.

I agree with Mr. Marman. The 17 year-old probably would not have to worry about being prosecuted. The company, however, should speak to an attorney in its state to determine whether it is violating the law in its state law.

If I were the seller, I would always follow the most restrictive laws. that is the only way not to be at risk of being charged with a violation.
