Legal Question in Business Law in California
Automobile sale
I was sold a vehicle on Feb23rd of this year under the impression that it was still under warranty. Now 3 months later I need to bring it to the manufactuer for warranty work only for them to tell me that the warranty expired in January. A whole month before I made the purchase. The manufactuer also stated that an extended warranty would have had to have been purchased 30 days prior to the date of expiration. Do I have the right to return the vehicle to the dealership due to no fault of my own and recieve my down payment back?

Re: Automobile sale
Your question doesn't say why you believed the vehicle was still under warranty. If the dealership told you it was then you probably have a valid claim against it, though I don't know whether you would be entitled to return the car for a refund. But if your misunderstanding was not the dealer's fault then it doesn't have any obligation.
