Legal Question in Business Law in California
Bought car 30,006 miles.Who pays 30k check?
I bought a van from a national dealership with about 30,030 miles on odometer. Included literature described necessity of proper maintenance and regular visits to authorized mechanic. A few months later it seemed to already need a tuneup and they agreed pointing out it never had the 30000 scheduled maintenance. They required that I pay for it (~$490), ignoring both that I'd bought it from them after 30000 and that it was under warranty still. Is this a breach of the implied warranty of general fitness? Loosing trust in other ways, too, forced me to go to a secondary dealership. What to do? Thanks

Unless the dealership gave you a notice which stated
that they owed you a 30k mile tune up you are out of
luck. Normally a warranty covers defects with the car
but not routine tune ups to keep the car running in
good condition. They only way you could have gotten
the dealership to pay for the tune up is if they had
agreed to do so in writing.

They are under no obligation to pay for or even have the 30k mile check done.
