Breach of contract/ May P Recover?
P sold goods to D for $1700, the goods to be delivered by P to the back door of D's store building. The goods were delivered and D paid P the $1700 in cash. P then told D that P had been put to $200 expense in delivering the goods which he had NOT FORESEEN and that D should pay half that extra expense, that is, $100 to P. D promised to pay P $100, but did not do so. P threatened to sue D on the promise and agreed to forbear such suit if D would pay the $100. D again promised to pay. P sues D for $100. D says there was no consideration.P says his forbearance to sue was a valuable consideration to support D's promise, May P recover?
