Broken Contract

Hired a moving company May 31, 2007 to move furniture and motorcycle prepaid them to move me from California to Colorado I asked for my stuff June 15, 2007 I only got my furniture on July 6, 2007 have been told my bike is on its way since July 6,2007 I want to file small claims but do I do it in Colorado or California? I paid for long distance move so I assume contract was broken in Colorado and I can file here. Any information would be helped. I already called police in California they said next would be for them to physically go see if they have the motorcycle but if they don't what do I do then?

Look first to the contract to see if you agreed to a choice of forum.

Where you can sue depends on a number of factors. For example, the contract may specify that you can only sue in a particular venue. Otherwise, it is generally where the defendant is located, but can also be where the contract was formed or where the contract was performed. Most attorneys would give you a free consultation to determine if a California attorney can help you. If not, you would be referred to a Colorado attorney.
