Legal Question in Business Law in California

Business Ethics

My friend is employed in a mangement position and makes most of the computer equipment purchasing desicions, on behalf of his employer. He is also an active partner in a different company that sells computer equipment. He has purchased many pieces of computer equipment on behalf of his employer through his own company / side business. He has never told his employer that he has a business on the side and has never told his employer that he was puchasing computer equipment from his own side business. He has never overcharged his employer or hurt his employer in any way, within these puchases.

Is this a legal practice? If not, which laws has he broken, and should he seek legal help?

Unless there is some fraud or cheating of the employer involved i doubt that any law is broken.
