I started a multimedia company with a partner. Our first bid was for a major company and my partner failed to work very much on the bid. His lack of enthusiasm had been an ongoing problem, and he still wanted 50% of the profit. As a result, I requested to dissolve the company and go our own ways. I stated that if he wanted my half of the company he would have to give me a fair value. We agreed to wait to see if the bid would be successful, and if so, see out the job to completion. He pulled our web site off-line without my permission. I threaten to sue if he did not put it back up. He stated that most of the graphics are his and that he needed them for his own site. After I threatened to sue he reposted the site without the graphics. He created many of the graphics for his current employer. He went on to say that it was illegal for us have the most of the graphics on our site anyway, and that I that I don�t have a foot to stand on. He was the one that originally wanted to use the images and I reluctantly agreed. Do I have any legal recourse against him if I loose this income because of his actions?

If it is true that the graphics on your web site

were the property of someone else and were used on your web site

without authorization, and you knew that going into the transaction, then you will not be able

to claim any damages because you couldn't use them.

However, you do have a claim against your erstwhile

partner if his lack of good faith effort on behalf of

your venture costs you money, if you can prove the loss.

You should consult with an attorney who can evaluate

the case given more information and all the details.
