Legal Question in Business Law in California
My business partner and I like to open LLC in California. The problem is, that my partner is not California resident, I am. He is European citizen, live permanently in Europe. Can I use his Power of Attorney signature and open LLC in California without him to be present in person?

I do not believe that there is a problem with your business partner living in Europe and being a foreign citizen. There is no requirement that he has to be physically present in the state to properly execute the appropriate documents. In answering your question, whether you can use the power of attorney depends on what powers are expressed in the document. I would be extremely hesitant in using such power even if it is expressly stated because it could add an additional issue if things go south.
