Legal Question in Business Law in California
I took my car to have an oil change at walmart and it was running great. no problems to speak of. the oil change took so long i decided to go into walmart to shop. when my car was finally finished i noticed the mechanic reving the engine and pressing both pedals to the floor. they said to reset the light, which they could not. i went home (right down the street less than 2 miles) and i immediately called walmart because when i pulled into my driveway my engivisne was smoking alot and looked like it may catch on fire. they told me to come back and they could check it out. on my way back my brakes went out and every light on my instrument panel came on and i pulled over and the car was leaking oil and brake fluid. the people at walmart said it couldnt have been they're doing so now my car is sitting in the driveway and i dont know what to do. i filed a claim and now what.
1 Answer from Attorneys
The first problem you have is "causation" and the probability that they "caused" the damages. So, at this point, you will want to (1) have a certified mechanic inspect the vehicle to write a 'damages' report and a probable causation of why and/or how it occured. Depending upon the results of that (those) reports, you will want to contact an attorney of your choice.
