We changed our independent contractors agreement, he has agreed to the pay change but refuses to return the contract. He acknowledges he has it excepted the checks for payment but will not produce the contract. What would be the purpose?

He will probably dispute there is an agreement to modify the contract.
As a Franchise Attorney I must ask that you repost your question with more detailed information. How was the independent contractor agreement changed? Is the change in writing? What do you mean by "He acknowledges he has it excepted the checks for payment?" Consult with a good business or franchise attorney in your area for specific advice.
