Is charging a community fee to move into an assisted living facility legal?

Yes; non-refundable community fees are both legal and widely charged. Ranges from $500 to $10,000 are found, depending upon the guest and the facility, and the fee is sometimes negotiable.

As the other attorney correctly mentioned, community fees are not only legal but also very much prevalent with assisted living facilities. Try to negotiate, as in these economic times pretty much everything is negotiable. You can also consult with an attorney in your area.
