Legal Question in Business Law in California
Charlene
I have an action for declaratory & injunctive relief pending against my HOA for illegally recording liens against me and for suspending my membership benefits. On the day of the OSC for the Prelim. Injunction, I agreed to continue the hearing to try to settle, but did so with the understanding that they would reinstate my membership privileges pending the hearing. This turned out to be a delay tactic on their part. Is there any chance to get the OSC heard sooner than the scheduled date by filing an exparte to shorten time?

Re: Charlene
Possibly, but the OSC hearing on turning a TRO into a preliminary injunction is normally VERY short anyway, even with a continuance. If you have the TRO, what's the hurry?
