Legal Question in Business Law in California
Civil Litigation:
We hired a company for Online marketing for our Dental office and we signed 3 months contract to be with them. They took long time to start the work.
When they started the work, they did not do anything they promised to do per the contract. They said we are going to have a meeting to discuss what
kind of promotions we are going to offer on google website before they run the google adwords. To my surprise after a month they came back and said
that they already started the google adwords and we need to make payment. When I asked them to show details they dont have correct landing page. When
asked about the call recordings which they said we will have they said they could not record the calls. At that time I gave them 2 weeks time to fix
all issues and take care as per the contract, but they never responded and they sent the invoices for 3 months service without even providing the service.
I ignored those invoices and did not make payment. Now they are suing me for $10,000 and received documents from the court. Do I need to hire a lawyer
to take care of this? Can I take care of this by myself. I never cancelled the service from them. Just asked them to provide correct service as they
agreed. How should I handle this situation?
1 Answer from Attorneys
You do need to at least consult with a lawyer. If you are being sued in small claims court, you will not use a lawyer in the trial, but you still need coaching on what evidence to present and what arguments to make. See http://limitedscopecounsel.com/small-claims/ If you are being sued in Superior Court you need an attorney even more. Make sure you leave enough time for your attorney to review your case and file the responsive documents - if you do not file a response on time you can lose the whole case.
