Legal Question in Business Law in California

Coercion-Work related?

If employed for a company, and forced to sign a random drug test form or you are fired, is this considered coercion? Would this be something that could be used as a case if more than half the staff got fired?

Re: Coercion-Work related?

You and your colleagues may have a good invasion-of-privacy lawsuit, unless you were in a safety-sensitive job (or professional sports). Please give me or another attorney a call to discuss this matter further. -Robert F. Cohen, Esq., (310) 858-9771.

Re: Coercion-Work related?

Thank you for your inquiry.

You may have a case for coercion, or as Mr. Cohen suggested, for invasion of privacy. You MAY have a case, but it really depends on other factors, such as what type of employment you have, whether or not a contract (such as a union contract) applies, and what, exactly was written or said before you signed the form.

I hope this helps, but if you have other questions, need more information, or feel that your friend needs legal representation, please feel free to email me directly at [email protected]. I'm happy to help in any way that I can.
