Legal Question in Business Law in California

I compete in mixed martial arts and my manager wants me to set up a DBA for deductions a whatnot. But the DBA would cost me about a 1000 a year and last year I only made 7000 from fighting. Not a lot, and this year might be around the same amount. Is it really worth it to set up a DBA at this point of my career?

Don't get your legal advice from somebody wearing a black belt. A DBA costs maybe $100, if that. And why do you need one for deductions and what not?

Actually, if he's wearing a black belt AND carrying a bar card, THEN you better listen. With that said, a DBA has NOTHING to do with deductions. If you want to have the right to conduct legal business under a business name other than your personal name, that is the only reason you need a DBA. Mr. Stone is right about how much it costs and it does not have to be paid once a year. I think they are renewable every 4 or maybe 5 years.

A DBA is not what you want........possibly forming an entity such as a limited liability company (LLC) or a corporation could produce some tax or other benefits, but a DBA is just a legal fictitious business name, and that would have little or no value for you without also forming a business entity such as a corporation or LLC. Talk to others who have been successful in your trade, find out who advises them on business matters (a very distinct specialty from coaching or managing).

The other attorneys are correct. You only need a DBA if you are doing business under a name that's different than your personal name. Consult with an attorney in your area for specifics.

I suspect they meant to advise you to establish an LLC, which could cost a couple of hundred to set up, but would subject you to annual franchise tax, which is $800 in California. Whether any of this woud help you will depend on your personal situation. I have done a lot of this work in the MMA field, and would be glad to speak with you.
