Legal Question in Business Law in California
I have a competitor in violation of the Lanham Act
One of my competitors has been selling products made in China for the Past 3+ years (about $15 to $20 million in sales) in a box with an American Flag on the box that states in small letters under it ''In God We Trust 9-11-01.'' The products have no other markings of any Country of origin.

It appears you have a case based upon the facts you present. Our office is in Anaheim and we handle Federal Court Actions in the District Court located in Santa Ana such as this. I would have to review your documentation. Please contact our office at 714 363 0220.
Re: I have a competitor in violation of the Lanham Act
The question becomes, what do you want to do about it? Do you want to try to shut them down? Do you want to obtain an injunction from producing without appropriate labeling?
The problem that you need to be aware of is simply one of cost. Attorneys fees in unfair competition litigation can be costly. Attorneys fees MIGHT be recoverable from the other side after trial.
I would be happy to discuss this matter with you.
We represent clients throughout Southern California. Irvine is no problem.
