Can a county refuse to allow an application for a DUI program, if there is only one existing program within a population of approx 500,000?

When I first read your question, I momentarily assumed you were asking about enrolling in an oversubscribed DUI program as an alternative to jail time under criminal diversion laws! Upon a second reading, I guess you'd like to create a second DUI program in a county that presently only has one, and the county is refusing to accept your application.

1. Have you presented an application and had it rejected already?

2. If so, what did you apply for, and to which county department?

3. Are you relying upon, or applying under, any particular law or policy?

4. What are your credentials?

5. Are you well funded, or seeking funding?

6. Was your application refused without evening being reviewed, or rejected after review?
