Legal Question in Business Law in California
a coworker (government contractor) recently bidded on a contract that our current company is bidding on. he has been working for another company that is bidding on the same contract. He has been using our current companies resources and time to assist the other company to win the contract.

The bidding is legal. Working for someone else during hours he's supposed to be working for the boss is not legal. Further, using your employer's trade secrets for your advantage and not the employer's is not legal. In most cases, there is a civil remedy - these transgressions are rarely prosecuted as crimes - but they do often result in being fired and/or sued for damages.
