the custodian (mercer) of my deceased father's 401k told us it is empty and that my father maybe moved it to another financial institution. they know where but says they can't tell us. my father quit his job one month before he died. what other steps can we take to find my father's missing 401k?

This is more of an estates question. If you are doing a probate, once the executor is appointed they can find out where it was transfered. If not, eventually you should receive a mailing with an account statement reflecting the account balance. Look carefully through yout fathers records for information. THese accounts are not established withour docuentation.
Seek advise from a probate attorney. SOmetims a letter for counsle can extract information. .
