Legal Question in Business Law in California
My Dad went to a local Hypnotherapist to purchase me one session, along with hypnosis Cds. The total came to $150. I already have someone who I have been working with who is working out just fine, and am not interested in the session or the CD's. I called the Hypnotherapist to ask her about gettig his money back, and she basically told me that we're in a recession and doesn't have $150 to just give me back. How can that be if I didn't even use her services??? The CD's I know are very enexpensive...the session is what costs the most. There is no return policy stated on the gift certificate. She told me she would think about it and call me back. Is there any law that can support me on this? I did not use her services, and did not touch the Cds.

Essentially, you are out of luck. Your Dad got you a present which clearly states that there is a no return policy. Unless the hypnotherapist wants to ignore that, she does not have to give you back the money. Also, you have the CDs, so you did get part of what was paid for. Again, she does not have to take them back.
