Legal Question in Business Law in California

We are a Delaware C corp doing business in California. Our product is typically sold over Internet and shipped to the customer. A customer from New Hampshire did "Check is in the mail" routine for two months after receiving the product and then sent us the check that bounced. Can we sue them in California or do we have to sue them in New Hampshire?

Your question concerns jurisdiction. In order to handle a case, a court will need to have two kinds of jurisdiction: (1) subject matter, and (2) personal. The California courts will not have personal jurisdiction over the prospective defendant unless you were lucky enough to find and serve him here. Therefore, your suit will probably have to be tried in New Hampshire.
