Legal Question in Business Law in California

department store

Question: My friend was at a department store in a fitting room trying on clothes, After finishing her time in the fitting room she left to purchase jewelry and then went to pay for the jacket that she choose to buy. As soon as she purchsed the jacket, the store security came and asked to escort her to their office. They said that she has ''switched the ticket of the jacket in the fitting room and the employee had seen her through the screen doors, while she was changing'' They checked her purse but found no evidence, only receipt with paid tags from another store and a small sissor. The employee kept harrassing for information and acussing without proof. Later the employee located the actual price for the jacket and there was only a 20.00 difference. My friend paid 44 dollars and the jacket was 71. What claims can they bring up against her. What should we do, becuase they are accusing us with false actions

Re: department store

If your friend was the one observed in the fitting room, why do you say they are accusing "us"? It appears you have left out some pertinent facts.

Based on what you've said, your friend can be charged with petty theft.
