Is Diminished Value a recoverable item of damages?
Is diminished value a legally recoverable item of damages in a court of law? I have sued a defendant in small claims for hitting my car while it was parked. I want to also recover diminished value as well. Is this a legally recoverable item of damages in a small claims court in your opinion? I just want to be sure, because I don't want to waste money on a diminished value appraisal if it's not.

Diminished value can be an item of damages.
I do not know if there will be sufficient diminished value to cover the cost of an appraisal -- especially if you did not have an appraisal before the car was hit.
