Legal Question in Business Law in California

Discounts on services?

I own a wedding business and I

asked a question earlier about

offering 1/2 off wedding planning

services to same-sex couples getting

married in California. I have been

advised that this would be illegal

(discrimination against non same-sex

couples).

As a different option what if I was to

offer 1/2 off all services to ANYONE

getting married through November.

But, I only advertise the offer

through gay/lesbian groups?

If ANYONE calls me to ask about my

services I would tell them about the

offer immediately. I just would not

advertise the offer to the general

public (ie: placing ads, etc).

Would this get me around the issue

of discrimination? I imagine that

how I spend my advertising dollars is

completely up to me. Correct?

Re: Discounts on services?

Absolutely. There is no requirement that you advertise to the general populace, otherwise the whole marketing industry would be out of business. If your target market is same sex couples, then it makes sense to advertise through those channels. As long as you honor the discount to any one that requests it.
