Legal Question in Business Law in California

Discriminated Against When Applying For A Job

In 1999, the employment agency I had signed on with had faxed my resume to a company which was looking for someone with my experience (commercial collections). I had 24 years experience in the field they were looking for (I was 53 at the time). When I inquired of the agency as to the status of my resume, I was told that the company had bascially told them, ''to keep looking''. Unable to obtain a job in the field I knew best, I went into another line of business, however, that company went belly-up. I've sent my resume to many companies and have never heard back from any of them. I feel that I'm being discriminated against because of my age or that they feel I'll want too much money, or both. What can I do about this? I'm sick of this discrimination.

Re: Discriminated Against When Applying For A Job

To prove age discrimination you would have to show more than just your age and the fact that you are not getting hired. Lots of peple are looking for work these days and only one person can get each job. To show discrimination you would basically have to be able to show that a specific company would have hired you had you been younger, but chose someone else who was less qualified in order to avoid hiring someone your age.

You also say you feel discriminated against "they feel I'll want too much money". This is a valid reason for an employer to decide not to hire you. If their budget only allows for the kind of salary a junior person would want, they can reasonably pass over someone more senior and focus on people who are likely to accept the salary the company wants to pay.
