Legal Question in Business Law in California

discrimination in the work place

My manager favors 1 assistant manager over the other 4 assistant managers, one of whom is me. This 1 assistant manager with 25 years of experience is part of a union. One of the other 4 assistant managers has 30 years of experience and is also part of a union (not me). This 1 assistant manager with 25 years of experience gets a set work schedule Monday - Friday 6:30AM - 3:00PM with Saturday and Sunday off. The rest of the assistant managers with me being one do not get a set schedule and must work around this 1 assistant manager's schedule. Is this discrimination, not just me but the other assistant managers?

Re: discrimination in the work place

You've got to look at the underlying reason for this preferential treatment. If it is due to your membership in a legally protected class (age, race, etc.), then it constitutes illegal discrimination, If, however, it's just because the manager doesn't like you as much, then there is no illegal discrimination.
