The name would have to be registered as a dba, unless that is the exact name of an entity you are forming. You would need to make sure the name is available. There are other formalities to registering the name. You should check with the City business license office and County Clerk as well as an attorney regarding formation of an entity to operate the business.

Yes, it's illegal, but not for the reason you think, unless you are a medical doctor with an appropriate license. See Business and Professions Code section 2054(a).
