Ebay suspended my account wrongly without warning. Can i sue them?

I'm selling watches on ebay. i registered with ebay on june/2006. i had some conflict with others ebay sellers that are selling watches because i was undersold. i was totally new to ebay system. in october 2006, ebay wrongly suspended my account without warning. they removed all my items. their reason was my account is linked to my brother's account. he lives at a different address. with the same reason, they also suspended my wife account. according to ebay rules and regulations, if a person have 2 accounts & 1 is suspended, the other will be suspended automatically. my brother account was suspended in march 2006. since i'm a seller, they have my address and credit card on file. my brother also have his address and credit card on file. we both have our confirm addresses on Paypal (an ebay division). but they firmly beleive that i owns both accounts. they refuse to investigate the matter. they believe that i'm a fraud yet when i asked them their fax number to prove that they are wrong, they refuse to give it to me. ebay does not even bother to answer my email. they refuse to resolve this matter on the phone or via live chat. can i sue them at my local court?

You could sue them, but I'm 99%+ certain that you would lose. They have a campaign against linked accounts and family bidding/selling groups which violate their rules. This has received a lot of publicity and some criticism. The suspended accounts are sometimes reinstated. eBay has lots of lawyers and they know what the can and cannot do to manage their business. This policy has been carefully reviewed, is consistent with their published rules, and appears to be fully within eBay's legal rights.
