Legal Question in Business Law in California
Emloyer responsible for a car accident?
My employer has requested that I list his company on the loss payee section of my insurance policy in the event of a car accident. He says his company could be sued if the accident happened on business call. He does not pay for the insurance. Is this true?

Re: Emloyer responsible for a car accident?
Yes, it is true. An employee who drives his personal car during the course and scope of job-related duties subjects the employer to likely liability for damages resulting from an accident.
However, I suggest you have a frank discussion with your own insurance agent before making the requested changes; the use of your car by you, but for business purposes, may affect your rate and your coverage.
All the cards should be on the table here. It does no one any good in the long run to try to fog one past the insurance company. If a higher premium results, try to pass it along to the boss; but in any case be up-front with the insurer about the business use of your car and be willing to arrange some way to cover the company for its exposure without cutting off any protection you have now for your personal use and personal liability.
This is a good opportunity to take advantage of the expertise of your insurance agent; that's something you pay for with your premium payments and you are entitled to a consultation on this issue. If you are not satisfied with the answers, if they are not clear and convincing, it may be time to change insurers.
