Legal Question in Business Law in California
Employeer's Right to Terminate
An employee stole my checks and forged my name. I terminated him stating only that he was terminated. I filed a complaint with the police providing handwriting samples from the employee that unquestionably match the forged checks. The police have yet to do anything. The employee was denied unemployeement benefits based on the information I provided about the reason he was terminated. I received a letter from an attorney stating he was representing the employee, the letter does not state why, and requesting copies of his employment records. Do I have to comply with the attorney's request? Should I hire an attorney or wait to see what comes?

Re: Employeer's Right to Terminate
You should probably have an attorney review the employment file for this employee before turning it over so that you will have a better idea what to expect.
Also, with respect to the forged check, you should make sure to give notice to the bank of any and all forgeries as soon as possible. You should not be liable for a forged check, employee or not.
I would be happy to discuss this matter with you.
