Employees working alone doing production work

We have a small mfg. business. Employees choose their own hours and work alone (no one else in the shop) doing production work. Is this illegal or simply poor practice?

This practice could have some adverse legal consequences and it is very poor practice; who will be available if someone has an injury at the workplace???

I know of no law that would prevent, or make against the law what you are doing. Depending on what is occuring, the industry practice and other matters you may want to evaluate alternatives.

There are isolated examples of laws prescribing crew size for a few industrial operations and processes. Your practice is very unlikely to be illegal per se, but it might pose an unacceptable risk. As an attorney with 35 years' prior experience in industry, I suggest you contact your liability insurance company for advice based on what the solo workers actually do. Maybe it's fine. Another possibility is to ask Cal-OSHA or a similar agency if your practice violates any safety standard they enforce or are concerned about.
