Legal Question in Business Law in California
Is an employer obligated to receive served papers for an employee?
1 Answer from Attorneys
It would be helpful if you could be more specific about the type of papers you are talking about. The employer might not have any choice.
If the employee owe money to someone with a judgment, the creditor can have the sheriff serve a wage garnishment on the employer. In that case, the employer must receive the papers and give a copies to the employee.
If the employee is a defendant in a lawsuit and someone is trying to serve legal papers, there are times where the process server can leave the papers with the employer rather than give them to the employee directly. This can happen when the plaintiff doesn't have home address and the employee hides when the process server arrives.
