Legal Question in Business Law in California
Expert Witness for Hospital negligence
I am suing the only local hospital for causing my
post-operative, antibiotic-resistant infection of the
incision made during reconstructive wrist surgery.
I was also injured in-hospital when the wrong Infusion
pump was used to administer the antibiotic
intravenously, and my I.V. occluded, and the movement
of the damaged wrist caused by the pain from the
"blown" I.V. destroyed the wrist reconstruction, and
making necessary a future "wrist fusion" operation.
I need an expert on the effect of using the wrong pump
and to say that the rare staph infection causing
necrosis only at the surgey site was likely contracted
in the hospital from asymptomatic staff, unsanitary
conditions and/or I.V.

Re: Expert Witness for Hospital negligence
From your description of the events which occurred during your stay at the hospital in question, it certainly sounds as if you may have a legitimate claim for medical malpractice. I would offer the following suggestions:
1: There are a number of MD/JD attorneys who specialize in the practice of medical/hospital malpractice. These attorneys are also doctors, and this may be an important advantage for your case. But whether or not your attorney is also a physician, it is important to hire an attorney who specializes in this area of law because he/she will have an edge over someone who does not.
2: Be sure you have you case filed within the time period of the statute of limitations for medical malpractice. This is important to remember, especially if you are in process of negotiating with the attorneys representing the hospital and/or doctors. Being in negotiations does not toll the running of the statute.
3. Be sure you consider naming as defendants in your lawsuit, all persons and/or entities who may reasonably be responsible for your injuries.
4. Keep meticulous records of events. If you haven't done so already, sit down and write out in detail exactly what happened to you, including all dates, names, and all details you can remember. Leave spaces so that you can fill in the things you can't remember now, but may remember later. Include all symptoms, problems, events, etc. that occurred and that resulted later from the events which occurred in the hospital.
5. Be sure to save all receipts and bills related to the events surrounding your hospitalization.
I wish you good luck in your endeavor.
