A Fiddler on the Roof

This is petty but important as a matter of principle.

I went with my wife to see A Fiddler on the Roof. We bought tickets in advance from Ticketmaster. We went to the show, sat down but our seats were too far back so we decided to ask for a refund. The box office would not refund so we chose to sell the tickets out front. The box office was sold out so we found someone in line and told him we had tickets. He asked where they were to which we said three quarters of the way back in the center of the aisle which is exactly where they were. He said he had no cash so we agree that we would accept a check because it was getting close to show time.

The man subsequently stopped payment on the check. After calling and leaving ten messages I got through and he said he was disappointed with the seats and his girlfriend forgot here glasses. He went to to fabricate a story saying that we told him they were orchestra seats. My wife and I were together and I would never have said that.

The check was for $132. I have his name, phone number and address on the check. What are my remedies here?

Small Claims is your forum. Your remedy is monetary damages in the amount of the ticket,cost of filing in Small Claims Court, cost for having him served, and maybe your travel to the court room. There are a few legal causes of action that would apply here and you should get some advice on that.

Small Claims Court, The People's Court, will be your next stop, sir. You should note that the date on the check should be the date scheduled for the performance.
