Fraud, Piracy, Breach of Contract, ect.

Sue, a singer,signs a recording contract with producer Abe for a very special and limited release of 500 CD's ONLY. Abe agrees to produce, and pay Sue for the 500 CD's. Abe then turns to Joe, the only one capable of meeting Sue's requirements, to be the actual technician making the CD's, with a contract, allegedly from Sue, for 5,000 CD's, with the intention of paying sue for only the first 500, and pocketing the rest. Joe, not knowing Sue, or her true intentions, makes, with his equipment, 5,000 Cd's. In the process of making the CD's at Joe's recording facility, both Sue and Joe discover Abe's treachery and deciept. Sue feels cheated and betrayed, Joe feel equally the same and that his reputation has been seriously impuned, ect. What crime has Abe committed, and what legal remidies are available to Sue and Joe? How do Sue and Joe pursue Abe in Court, how would those actions be titled, or called, and what, if anything, would they hope to recover.

It sounds like Sue and Joe discovered the fraud in time to prevent Abe from carrying out his nefarious intentions. Is that correct?
