Legal Question in Business Law in California

Gift Certificate revokation

We bought a business from a person, and After the contract was completed, we gave the seller a gift certificate for $1000 towards food at the resturaunt, we were being nice. I would like to revoke the gift certificate because I do not want her to come into the store anymore. She has used abusive verbal language towards myself and my employees, and has attempted to abuse her gift certificate by purchasing more than the agreed daily amount and buying for others than herself. Can I just ''cut her off'' or do I need to pay her the remaining balance? She did not pay for the certificate. The remaining balance is around $800.

thanks

Re: Gift Certificate revokation

from the facts given, if you gave the seller the $1000 gift certificate as a gift, and it was not part of the contractual sales agreement between you two previously of the business, then the gift is completely revocable on your part so long as the seller did not supply any consideration and/or detrimental reliance in return for the gift certificate. if you would like further legal assistance in this matter, feel free to email my Law Firm directly. thank you for your question.
