You can't be an employee and be an independent contractor. You are either one or the other. It sounds like they are your employees, and you are claiming that they are independent contractors to avoid having worker's compensation insurance. If they get hurt on the job and you do not have worker's compensation insurance, they can sue you civilly and the statutory caps that apply in worker's compensation cases will not be in place to protect you. Furthermore, you face other problems like fines and penalties.
