Legal Question in Business Law in California

My husband worked for a tree service company in California for 29 years as an estimator. During his time there he has established a large clientele. He was let go at the end of last year (2010). The company continues to let his customers believe he still works there. When they call asking for him they tell the customer he is busy can they schedule someone else to come out. Upon leaving he had to surrender his phone and they have not changed the voice mail message which states he still works there. Also the web site continues to use his picture as the vice president. My question: is there anything we can do to stop this company from exploiting my husband this way.

Have a lawyer write them a letter and tell them to stop.

Absolutely, and you can collect money damages too. You are going to need to gather proof of what you say they are doing, in forms that are admissible evidence, before you move forward. They are likely to pull everything and change their practices once they know you are thinking of taking action against them. If you would like a no obligation consultation to go over the facts in more detail and outline your options, please feel free to give me a call.

Definitely. You can ask them to stop and sue them for damages. If you want to claim, however, better seek a lawyer for advice. It would be best to gather all evidence first before you give them notice to stop what they are doing, otherwise, they might just remove any trail or evidence of using your husbands name in their business.
