Legal Question in Business Law in California

Interference with business relationship

What are my remedies against someone who goes to someone I have a fee contract with, and asks him to modify the contract and pay the other person part of my fee. My contract obligation was performed, he received $250,000. I get 5%. A third person without a contract of any kind thinks that part of the fee should go to her.

Re: Interference with business relationship

The remedies are sued for intentional interference with contract. Anything that she does to interfere with your contract an attempt to divert any or all of your fees to is actionable and you should sue the heck out of her. In order did this you must have a good business/litigation attorney who is expert in his field. Tell him all the facts, information, names, addresses, telephone numbers, pay him to investigate and he will give you, hopefully, good advice with alternatives. Do not do anything yourself you're not skilled, expertise, knowledgeable enough (as can be seen by your question) or informed.I have been practicing law in the San Francisco Bay area for approximately 35 years and expert in the area in the category in which your question is placed. I feel I can help you in this matter and if you wish to consult with me please contact me at 925-945- 6000.

Re: Interference with business relationship

If the person with whom you have the contract does what the third party is asking, and the third party actually knows about the contract between you, you have a potential lawsuit against the third party for intentional or negligent interference with contractual relations. In addition, you would have at least a breach of contract cause of action against the person with whom you have the contract.

Re: Interference with business relationship

I concur with Attorney Hoffman.

There may be a suit against the 3rd party, but certainly one aginst the person with whom you have a contract for breach.

It is clear we do not have the entire facts. That having been said, another person who interferes with a contract is liable for damages that flow therefrom. If you have already performed, and are due the money, you are to be paid now, withut offset or change.
