Laid off

ok my question. I filled out an

application at this place and it asked if

I had a felony and I answered yes. A

month later I get a call about the job

and they ask the samething and tell

them I am trying to get it expunged.

So he says he has to call the payroll

do. And see if they will allow it. They

say yes, about a month and a half

later a couple of guys try to apply with

a felony, they want them on so they

lay me off to cover there tracks and

tell me to come back when I take care

of the felony. Do I have a case once I

get a copy of my application?

California is an at will state, which means you can be fired for no reason or any reason, so long as it's not illegal. I know of no reason to prevent the employer from terminating you because of your past, however stupid that might be.

On the other hand, if you believe there is a racial or national origin component, for example, that caused the employer to discriminate against you, then there might be grounds for an attorney to take a further look.
