Legal Question in Business Law in California
Landlord listed my grocery business for sale without my knowledge. Do I have any
My wife and I own a small grocery business with a five year lease and have over one year to go on the lease.
We found out that the landlord posted ads in two well known publications in our area, listing our business for sale as a business opportunity. He did this without our knowledge or permission. Our customers became alarmed and we feel it undermined our business. The business is located in a small town.
We have personal knowledge that he was asking potential buyers to meet with him only and not to contact us.
Do we have any legal recourse in this matter? It seems highly unethical for a landlord to be able to do this.

It sounds like you may have a case for trade libel or slander. You can obtain punitive damages in such a case if you can prove the defendant acted with fraud, malice or oppression. If you would like to discuss your case further, please contact me. [email protected]

Depending upon all of the circumstances you may have causes of action for defamation and Unfair Business Practices.
You will need to discuss this in more depth.
If you are in So. Cal. I would be happy to speak with you.
