Legality of Recording a Prerecorded Message

I know it's legal to record a phone conversation only with the other party's consent. How does this law apply if, on the other end of the phone there is a recording. Is it possible to record the recording, without notifying the person (or business) that made the recording?

I'm not sure this question has ever been addressed, and I'm certainly not going to tell you it's legal and that you can do it, but on the other hand it is possible that a judge deliberating on a prosecution for this would hold that what you did was not within the purposes of the law, and would let you off the hook. If some other lawyer knows the answer, I'd sure like to hear from you!
