Legal Question in Business Law in California

Need a liquor license

My wife was convicted then expunged of misdemeanor grand theft about 13 years ago, ABC is asking for her livescan fingerprints. Does this mean I will not be able to obtain the license because of my wife's past? She is not in any way responsible or working for the business. I have a partner and we are forming a corporation.

It does not necessarily mean that. You should talk to an attorney that can sit down and give you more detailed information then a BBS board like this can online.

You might also consider going over the policies in effect with the ABC directly, either by exploring their Web site in detail, or by asking for an appointment to discuss their policies at one of their many statewide branch offices, either with all details on the table or anonymously as a theoretical question. I'd recommend candor; there is no need to remain in suspense and doubt if you can get a straight answer as to what is probably going to happen to your application. On the other hand, I'd go ahead and apply even if the staff opinion is that your chances are slim. The staff isn't God and they can't make the final decision.
