Legal Question in Business Law in California

Lock Picking Devices

What constitutes a "bonafide locksmith"? I want to pick locks for a completely legal enterprise I am about to engage in and I would like to purchase a "Lockpick" mechanical picking gun. I have found a place I can do so but I am obligated to fill out a form stating I am a lock smith, which I am not. Is there a legal way for me to purchase lock picking guns without lying?

Re: Lock Picking Devices

Look at the California Business & Professions Code, sections 6980 and following, especially 6980.12. Available at county law libraries and many public library reference sections.

The definition of "locksmith" in the statute is fairly broad and seems to go beyond guys who do it as their sole livelihood, and there doesn't seem to be a formal training requirement. Thus, you may meet the definition. If in doubt, ask an attorney who is familiar with your proposed activity whether you meet the definition.

Also be cautioned that there is a Penal Code prohibition against persons being improperly in possession of burglar tools, which includes lock-picking apparatus.
