Legal Question in Business Law in California
I own a manufacturer company. we took on a new account, did a small sample order that got approved. Then we were given a PO for a 2 week order. In the process of producing this larger order, we found that our facility was not set up to handle this account. We notified the customer that we would finish this 2 week order, but would not be taking anymore orders. We have this order on a truck ready for delivery but the customer has informed us they will not accept it. It has been sitting on our trailers for over a month (since the order was due). We are into this order for between $7500 and $10,0000 not counting the lost time that the product has been sitting on one of our trailers.
Do we have any legal recourse on a matter like this?

Yes, you can sue for breach of the purchase order. I would be happy to review the purchase order, and discuss the next steps with you. Seth Wiener, Esq. 925.487.5607
