Legal Question in Business Law in California

mechanics lien

I has a dealer drop off 3 scooters without prior permission, after they dropped them off, the then stated they did not want them and wanted their money back. This is not allowed in the contract they signed. Do i send them a storage bill then file a lien or can i file a lien without a storage bill.

Re: mechanics lien

The term "mechanic's lien" refers to a lien held by someone who furnishes labor, materials or equipment to the owner in connection with a "work of improvement" to real property. A storage lien is not a mechanic's lien - even if the person who holds it is, by trade, a mechanic. There is no real estate involved. Your situation involves a contract dispute, and (if necessary) should be litigated as such, including, perhaps, a claim for storage costs. See a lawyer, or if the amount in dispute doesn't warrant, take the dispute to Small Claims Court.
