Legal Question in Business Law in California
Still my money?
I moved out of my old apartment on September 30, 2001 and cancelled my DSL internet service when I moved out. I also sent the DSL modem that was given to me back to the DSL provider. The provider went bankrupt the day I moved and and handed their accounts over to a different company. Apparently, my cancelled account info didn't make it to the new company and they continued to bill me $59.90 each month through the present month. I noticed the charges, but assumed that the charge was my mobile telephone bill which is $59.95. Now, I'm requesting my money back they've been taking each month, and they're saying I can't have it, because I should've noticed the missing money long ago. I think that it doesn't make it OK to take my money and keep it, just because I didn't notice and want my money back. Who's right here? How can I get my money back?

Re: Still my money?
It is still your money. If they don't refund it cheerfully,
tell them they will have to refund it anyway in small claims
court.
I had a problem with an ISP which I resolved by pointing out
that their mission statement, posted on their web site, promised
great customer satisfaction. I said I was a customer and was not
satisfied. This worked for me. You should look for a creative way
to get what you are entitled to without going to court.
