Legal Question in Business Law in California

non-negotiable deposit

Recently, I recieved in the mail, what I BELIEVED to be my final pay check from my former employer. Normally, my checks had been directly deposited into my account, however, this was the first time i'd gotten anydeposit info. so I assumed it was "policy" for final payments to arrive in the mail. I deposited what looked to me like my check. I did this at an ATM, on Tuesday evening.(7/27)

For at least, the next 4 days, my account showed a positve balance.On(8/5) I got a notice dated 7/29, informing me of MY mistake. I want to know whether the bank, is also to blame, in this matter. If they knew of the error, WHY,did my account show a positive balance?? withdrawals, slips show normal transactions subtracting amounts frompositive funds in my account, (proir to deposit acct. was over drawn by approx. $16.00 ) On Fri. the 30th, it showed a balance of 60 some odd dollars! for ea. transactoin I was slapped with anadditional $18.00 fee Why wasn't I informed on this matter immediatly, by phone, why did THIS notice take an unusually long time for me to receive it??(mailed on 7/29 & recieved on 8/5.)

Re: non-negotiable deposit

Let me get this straight, you deposited something that was not a check into an ATM and now you think it is the bank's fault? No wonder you couldnt hold down your last job.
